1. Introduction

These Terms of Service ("Terms") govern your access to and use of the HireFlow platform and services provided by Interactive Foundry AG ("Company", "we", "us", or "our"), a company registered in Switzerland.

By accessing or using HireFlow, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use our services.

3. Description of Services

HireFlow is an AI-powered recruitment platform designed for Swiss companies with high-volume hiring needs. Our services include:

  • AI-assisted job posting creation and multi-platform distribution
  • Automated candidate screening via WhatsApp, SMS, and voice
  • Candidate qualification scoring and ranking
  • Interview scheduling and coordination
  • Candidate pipeline management
  • Multilingual communication (German, French, Italian, English)

4. User Accounts

4.1 Account Registration

To use HireFlow, you must create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials.

4.2 Account Requirements

  • You must be at least 18 years old
  • You must have the authority to bind your organization to these Terms
  • You must provide a valid business email address
  • You are responsible for all activities under your account

4.3 Account Security

You must immediately notify us of any unauthorized access to your account. We are not liable for any loss resulting from unauthorized use of your account.

5. Acceptable Use

You agree not to:

  • Use the platform for any unlawful purpose
  • Discriminate against candidates based on protected characteristics
  • Post false, misleading, or fraudulent job listings
  • Attempt to reverse engineer or copy our AI technology
  • Interfere with the platform's security or functionality
  • Share your account credentials with unauthorized parties
  • Use the platform to collect data for purposes other than recruitment
  • Violate any applicable employment or data protection laws

6. Employer Responsibilities

As an employer using HireFlow, you agree to:

  • Comply with all applicable Swiss employment laws and regulations
  • Ensure job postings are accurate and non-discriminatory
  • Verify candidates' work authorization as required by law
  • Handle candidate data in accordance with data protection laws
  • Make final hiring decisions (AI provides assistance, not decisions)
  • Respond to candidate applications in a timely manner
  • Not use candidate data for purposes unrelated to recruitment

7. AI-Powered Features

7.1 AI Assistance

HireFlow uses artificial intelligence to assist with candidate screening, communication, and scheduling. AI-generated assessments and scores are provided as recommendations only.

7.2 Human Oversight

You acknowledge and agree that:

  • All final hiring decisions must be made by humans
  • AI assessments should be reviewed and validated
  • You remain responsible for compliance with anti-discrimination laws
  • Candidates have the right to request human review of AI decisions

7.3 AI Limitations

While we strive for accuracy, AI systems may produce errors. We do not guarantee that AI-generated content, assessments, or recommendations will be error-free or suitable for all purposes.

8. Fees and Payment

8.1 Pricing

Service fees are as specified in your subscription agreement or on our website. All prices are in Swiss Francs (CHF) unless otherwise stated.

8.2 Payment Terms

  • Fees are billed in advance on a subscription basis
  • Payment is due within 30 days of invoice date
  • Late payments may incur interest at the statutory rate
  • All fees are non-refundable unless otherwise specified

8.3 Price Changes

We may modify our pricing with 30 days' notice. Continued use of the service after a price change constitutes acceptance of the new pricing.

9. Intellectual Property

9.1 Our Property

HireFlow, including its AI technology, software, design, and content, is owned by Interactive Foundry AG and protected by intellectual property laws. You may not copy, modify, or reverse engineer any part of our platform.

9.2 Your Content

You retain ownership of content you submit (job postings, company information). By submitting content, you grant us a license to use it to provide our services.

10. Data Protection

Our collection and use of personal data is governed by our Privacy Policy. By using HireFlow, you agree to our data practices as described therein.

As a data processor, we will process candidate data on your behalf in accordance with applicable data protection laws, including the Swiss Federal Act on Data Protection (nDSG) and GDPR where applicable.

11. Confidentiality

Both parties agree to keep confidential any non-public information disclosed during the use of the service. This obligation survives termination of these Terms.

12. Disclaimer of Warranties

HireFlow is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

  • Warranties of merchantability or fitness for a particular purpose
  • Warranties that the service will be uninterrupted or error-free
  • Warranties regarding the accuracy of AI-generated content
  • Warranties that candidates will meet your requirements

13. Limitation of Liability

To the maximum extent permitted by Swiss law:

  • We are not liable for any indirect, incidental, special, or consequential damages
  • Our total liability shall not exceed the fees paid by you in the 12 months preceding the claim
  • We are not liable for hiring decisions made based on our AI recommendations
  • We are not liable for actions of candidates or third parties

14. Indemnification

You agree to indemnify and hold harmless Interactive Foundry AG from any claims, damages, or expenses arising from:

  • Your use of the platform
  • Your violation of these Terms
  • Your violation of any applicable laws
  • Your hiring decisions
  • Content you submit to the platform

15. Term and Termination

15.1 Term

These Terms remain in effect while you use HireFlow or maintain an account.

15.2 Termination by You

You may terminate your account at any time by contacting us. Prepaid fees are non-refundable.

15.3 Termination by Us

We may suspend or terminate your account if you violate these Terms, fail to pay fees, or for any other reason with 30 days' notice.

15.4 Effect of Termination

Upon termination, your access to the platform will cease. We will retain your data as required by law and our Privacy Policy.

16. Modifications to Terms

We may modify these Terms at any time. Material changes will be notified with at least 30 days' notice. Continued use after changes constitutes acceptance of the modified Terms.

17. Governing Law and Jurisdiction

These Terms are governed by the laws of Switzerland, without regard to conflict of law principles.

Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of the Canton of Schwyz, Switzerland.

18. General Provisions

  • Entire Agreement: These Terms constitute the entire agreement between you and us
  • Severability: If any provision is found invalid, the remaining provisions remain in effect
  • Waiver: Failure to enforce any right does not constitute a waiver
  • Assignment: You may not assign these Terms without our consent
  • Language: These Terms are written in English; translations are for convenience only
